Are some businesses "grandfathered in" under the ADA? Business owners in older construction are often under the mistaken impression that they are "grandfathered in" under the ADA and not required to comply under any circumstances. This is incorrect. The compliance requirements change based on various factors including the age of a building, and it may be that the readily achievable standard (or some other standard) applies, but the requirements are always there - they are never completely non-existent. A good ADA lawyer can determine what a particular business is require to do.
